About these terms
These terms apply when you use limberly.co.uk and the Limberly service. By using Limberly or creating an account, you agree to them. Please read them. If you do not agree, do not use Limberly.
Limberly is run by Thrive Haven Ltd, a company registered in England and Wales (company number 16319387). Our registered office is 22 Waltham Road, Newton Abbot, Devon, TQ12 1LH, United Kingdom. In these terms, “we” and “us” mean Thrive Haven Ltd.
How we use your personal data is explained in our privacy policy, and how we use cookies in our cookie policy.
What Limberly is, and what it is not
Limberly is a way to find a physiotherapist near you. We show you physios who are registered with the Health and Care Professions Council (HCPC), what they treat, where they work and what they charge. Later, you will be able to book and pay them online.
We are not a healthcare provider. We do not give treatment or medical advice, and we are not part of the NHS. Physios on Limberly are independent professionals. They are not our employees and they do not act for us. Each physio is responsible for the assessment, advice and treatment they give you.
We check each physio’s HCPC registration before their profile goes live, and may check it again later. We cannot promise that a registration has not changed since our last check. You can always check a physio yourself on the HCPC register.
Emergencies
Limberly is not an emergency service. If you are seriously ill or injured, or your life is at risk, call 999 or go to A&E.
Call 999 straight away if you have back pain together with numbness around your bottom or genitals, or you suddenly cannot control your bladder or bowels. These can be signs of a serious problem that needs treatment in hospital.
If you need medical help quickly but it is not an emergency, call NHS 111 or go to 111.nhs.uk.
The body map and other health information
Our body map, questionnaire and blog give general information to help you understand your options and find the right physio. They are not a diagnosis and they are not medical advice. They cannot replace an assessment by a physio, a GP or another health professional.
Do not delay getting help, or ignore advice from a health professional, because of something you read or saw on Limberly.
Who can use Limberly
- You must be 18 or over to create an account.
- For now, we do not accept patients under 18, including when a parent or carer books for them.
- Limberly is for people looking for physiotherapy in the United Kingdom.
Your account
Accounts are opening soon. When you have one:
- Give us true and up-to-date information, and keep it that way.
- Keep your password to yourself. You are responsible for what happens in your account.
- Tell us straight away at support@limberly.co.uk if you think someone else has used your account.
- One account per person. Do not create an account for someone else or pretend to be someone else.
You can close your account at any time by emailing support@limberly.co.uk. Closing your account does not cancel appointments you have already booked; please cancel those first.
Using Limberly fairly
You must not:
- break the law, or help anyone else to, while using Limberly;
- give false information, or pretend to be someone you are not;
- share another person’s health information without their permission;
- harass, threaten or abuse physios, patients or our team;
- copy, scrape or collect data from Limberly, including physio details, by automated means or otherwise;
- use details you find on Limberly to send people marketing;
- try to get into parts of Limberly or other accounts you are not allowed to use, or disrupt the service;
- upload anything that contains viruses or other harmful code.
If you break these rules we may suspend or close your account (see “Suspending or closing accounts”).
If you are a physio
These extra terms apply if you list yourself on Limberly. You must:
- be registered with the HCPC as a physiotherapist, and keep that registration current;
- tell us straight away if your registration lapses, is suspended, has conditions placed on it, or you are under a fitness to practise investigation;
- hold professional indemnity insurance that covers the work you offer through Limberly, and show us proof if we ask;
- keep your profile accurate, including your prices, the areas you treat, your clinic addresses and whether you offer home or video appointments;
- charge patients the price shown on your profile at the time they contact or book you;
- follow the HCPC’s standards and the law, including data protection law. You are responsible, as a separate controller, for the clinical records you keep about your patients.
Our checks. We check your HCPC number on the public register before your profile goes live and may check it again later. We may ask for other evidence, such as proof of insurance. We decide whether to publish a profile, and we may hide or remove it if we cannot confirm your details or you break these terms.
Your content. You keep ownership of what you write and upload. You give us permission to show it on Limberly and to let search engines find it, and to shorten or format it to fit our pages. This permission ends when you remove the content or close your account, apart from copies in backups that are deleted on their normal schedule.
Fees. Listing your practice is free, and we do not charge physios anything today. When booking launches, we will be paid only when a patient books you through Limberly, with no yearly subscription and no lock-in. We will tell you our fee in writing at least 30 days before it applies, and you can close your account before then without paying anything.
Bookings and payments
This section applies when booking launches. You cannot book or pay through Limberly yet. Before booking opens, we will add the full rules for booking, cancelling and refunds to these terms, and you will see them before you pay.
When booking is open:
- Your appointment is an agreement between you and the physio. The physio is responsible for the appointment and the care they give.
- Prices will be shown in pounds sterling before you pay, and you will see the total before you confirm.
- Payments will be taken by Stripe. We will never see or store your full card number.
- Physios must take payment for appointments booked through Limberly only through Limberly, and must not add charges that were not shown at booking.
Your legal rights stay the same. By law, services must be provided with reasonable care and skill, and you usually have 14 days to change your mind about a service bought online. If you ask for an appointment inside those 14 days, you may have to pay for any part of the service already provided. Nothing in these terms takes away your rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.
Our content
The Limberly name, logo, website design, body map, text and software belong to us or the people who licensed them to us. You may use them to use Limberly for yourself, but you may not copy, change or sell them without our written permission. You may share links to our pages.
Changes to Limberly
We are building Limberly in stages, so it will change. We may add, change or remove features. We try to keep the site running all the time, but we cannot promise it will never be unavailable, for example during maintenance. If a change affects bookings you have already made, we will tell you.
Our responsibility to you
What we do not limit. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Nothing in these terms affects your legal rights as a consumer.
If you use Limberly as a patient. If we break these terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that was a foreseeable result. Loss is foreseeable if it was obvious it would happen, or if we both knew it might happen when you started using Limberly. We are not responsible for loss that was not foreseeable. Limberly is for your own private use; we are not responsible for business losses such as lost profit or lost business opportunities.
Treatment is the physio’s responsibility. We are responsible for the service we provide: the website, the listings, and (when they launch) our booking and payment tools. We are not responsible for the assessment, advice or treatment a physio gives you. That does not limit our liability for our own negligence or our own breach of these terms.
If you use Limberly as a physio. You use Limberly for your business. We are not liable to you for loss of profit, business, goodwill or data, or for indirect loss. Our total liability to you in any 12 months is limited to the greater of £100 and the fees you paid us in those 12 months. These limits do not apply to anything listed under “What we do not limit”.
Suspending or closing accounts
We may suspend or close an account, or hide a physio profile, if:
- you seriously or repeatedly break these terms;
- we cannot confirm a physio’s HCPC registration or insurance, or the registration lapses;
- we need to, to protect patients, physios or Limberly, or because the law requires it.
We will tell you why, unless the law or a safety concern stops us. If you think we got it wrong, email support@limberly.co.uk.
Changes to these terms
We will update these terms as Limberly grows, especially when accounts and booking open. The date at the top shows when they last changed. If you have an account and we make an important change, we will email you at least 30 days before it takes effect. If you do not agree to the change, you can close your account before then.
Complaints
About Limberly. Email support@limberly.co.uk. We aim to reply within 5 working days.
About the care a physio gave you. Raise it with the physio or their clinic first. Please tell us too, so we can act if a physio is breaking these terms. If you are worried about a physio’s fitness to practise, you can raise a concern with the HCPC.
Which law applies
These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you can also bring proceedings in Scotland. If you live in Northern Ireland, you can also bring proceedings in Northern Ireland.
If a court decides that part of these terms is not valid, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. These terms are between you and us; nobody else can enforce them.
